The office was established by the state constitution in 1889 but was split into two separate offices—the Commissioner of Labor and the Commissioner of Agriculture—in 1966, when the two departments also split due to a constitutional change approved by the electorate in 1964.

The North Dakota Supreme Court determined that Moodie was ineligible to serve, and he was removed from office on February 16, 1935.
